Your initial question may be where to start. We provide an overview of a typical surrogacy journey from a legal perspective, including the services which may be relevant to you.
While you will be provided with an instruction letter detailing all the post-birth steps you will need to take, some of the items which may be relevant include, obtaining a certified birth certificate, social security number, and U.S. passport.
For our international clients, we also suggest that you plan on remaining in the U.S. a minimum of 4-6 weeks following the birth in order to complete the post-birth steps.
The birth record refers to the information which is collected following the delivery, while the birth certificate refers to physical document with which we are all familiar. It’s important to recognize the distinction for a variety of reasons.
Birth certificate requests are state specific. Generally, birth certificates are available within 30 days following the birth, though expedited birth certificates may be available.
For our international clients, you will be provided with information regarding the most efficient means of obtaining an expedited passport. This may include appearing in person at a regional passport office or working with a passport expediter. The suggested avenue will depend on the city where your child is born.
An apostille authenticates documents issued by U.S. governments for use abroad. In many instances, you will be notified if an apostille is required for your particular circumstances. In such case, we will either obtain the apostille on your behalf or provide you with the relevant application so that you may obtain it.
For our domestic clients, you will be notified whether you may apply for the social security number at the delivery hospital or if the request for a social security number should be submitted separately.
